This Legal Notice governs the access, browsing and use of the website and of the platform of installable web applications (PWA) DatomWorx.
DatomWorx is a platform of installable web applications (PWA) aimed at education and training, especially in the driving field. It currently includes, among others, Simulador de Tráfico, Exámenes DW, Organizador de Prácticas, Rutas DW. Each application may offer different features (drawing roads and trajectories, replaying the path of vehicles, saving and sharing content, viewing real maps, grading tests and exams, etc.). DatomWorx may add new applications in the future, which will be equally subject to this Legal Notice and the rest of the legal documents, unless expressly stated otherwise.
Browsing DatomWorx grants the status of user and implies full acceptance of the clauses included in this Legal Notice, as well as the Terms and Conditions of Use, the Privacy Policy and the Cookie Policy.
Access to the features of DatomWorx requires prior registration with a username and password or by signing in with a Google account. The user undertakes to provide truthful information and to keep their credentials confidential, being responsible for all activity carried out from their account.
The use of DatomWorx is intended exclusively for persons over 18 years of age. The economic terms of the different plans (Trial, Free, Pro and BOSS) are detailed in the Contracting Conditions.
The user undertakes to make diligent, lawful and good-faith use of DatomWorx, refraining from:
All the contents of the website and of DatomWorx (texts, images, source code, graphic design, logos, trademarks, icons, sounds, animations, videos, sticker library, backgrounds, etc.) are the property of the owner or are duly licensed. Reproduction, distribution, modification, public communication or any other form of exploitation without express authorisation is prohibited and constitutes an infringement of intellectual property rights.
Specific software protection: the code of the applications (including HTML, CSS, JavaScript, their algorithms and their structure) is the exclusive property of the owner and is distributed solely for its execution on the official DatomWorx domains. It is expressly forbidden to download, copy, host, reuse, redistribute or run such code, in whole or in part, on any other site, domain or service, as well as to circumvent or alter its technical protection measures. The owner uses automated detection means to identify unauthorised uses; any infringement will be pursued by civil and/or criminal means and through the corresponding content takedown procedures (including DMCA).
The trade name "DatomWorx" is used exclusively by the owner.
The content you create in DatomWorx (projects, trajectories, simulations, exams, settings and similar) is your property. By uploading them to DatomWorx you grant us a limited, non-exclusive, worldwide and royalty-free licence to store, process and display them to you for the sole purpose of providing the service. This licence ends when you delete the content or your account.
DatomWorx may contain links to third-party websites (Stripe, Google, etc.). The owner assumes no responsibility for the content, policies or services provided from those sites. Access to them is made under the sole responsibility of the user.
The owner does not guarantee the absence of errors in accessing the site, in its content, or that it is permanently up to date. However, we declare that we adopt the necessary measures to avoid, correct or update them as soon as possible.
The content generated with the DatomWorx applications (simulations, trajectories, images, videos, scorings and similar) is illustrative and educational in nature. They do not constitute official traffic instructions, legal, technical, expert or professional advice, nor do they replace traffic regulations or formal driving-school training.
In particular, the owner is not liable for the damages, losses or decisions that the user or third parties may make based on the generated simulations. Real manoeuvres on public roads must be carried out following exclusively the traffic rules in force and the instructions of accredited teaching staff or the competent authorities. The owner is also not responsible for the use made of the simulations, images or videos generated by users outside DatomWorx.
The user's breach of the obligations established herein may give rise to the suspension or cancellation of their account, without prejudice to any civil, administrative or criminal liability that may apply under current legislation (LSSI-CE, GDPR, LOPDGDD, intellectual property regulations and other applicable rules).
The owner reserves the right to make any modifications it deems appropriate to the website or to DatomWorx, and may change, remove or add contents, applications and services provided. Modifications that substantially affect the legal clauses will be notified to the user with adequate notice in accordance with the procedure described in the Terms and Conditions of Use.
This Legal Notice is governed by Spanish law. For the resolution of any dispute, the parties expressly submit to the Courts and Tribunals of Valencia, waiving any other jurisdiction that may correspond to them, unless mandatory law establishes another jurisdiction (especially for consumers and users).
